• Service Request: When you make a booking request through the platform to obtain service(s) through Service Provider.
• Additional Service(s): Additional Service(s) refer to the extra services available on the PGORIDES SERVICES PRIVATE LIMITED platform, which may be either paid or free.
• Service Providers: The Services are provided / offered by third party vehicle operators, or riders who wish to offer such Services through the Platform.
• Site: The Site represents the gorides.in website and mobile applications that can be accessed or downloaded on a PC, smartphone, or tablet.
• User: A User refers to any individual, company, partnership, legal entity, or business entity using the service, whether as a Visitor or as a User Account owner who has accepted our Terms of Service specific to their account.
• User Account or Account: User Account or Account denotes either a Personal or Business account created by a user to access all the services offered on the platform.
3. INTERPRETATION
• Whenever the singular form is used, it encompasses the plural form, and vice versa. The term "includes" should be understood as "to include but not limited to."
• Words indicating a specific gender also encompass all other genders.
• Any mention of a statute, ordinance, or any law includes all associated regulations, instruments, as well as any existing consolidations, amendments, re-enactments, or replacements currently in effect.
• Headings, bold text, and italics (if present) are included for ease of reference and do not establish, restrict, or alter the meaning or interpretation of the terms in this Agreement. All references to the singular include the plural and vice versa and the word "includes" should be construed as "without limitation".
4. INTRODUCTION AND SCOPE
• Scope. These Terms govern your use of the Website and Mobile Application, encompassing the services they provide. It is crucial to clarify that, unless explicitly stated otherwise, these Terms do not apply to Third-Party Products or Services. The terms and conditions governing such third-party offerings are subject to their respective terms of service.
• Eligibility: Certain services accessible through the Website and Mobile Application are not available to individuals under the age of 18 or to users who have been suspended or banned from our system for any reason.
If the Company becomes aware or obtains credible evidence that you have provided false information about your age, it reserves the right to deactivate your account.
• Service Provider limitations: Services are provided directly by independent third-party contractors (“Service Providers”). These Service Providers are not employees of the Company or its affiliates. The Company functions solely as an intermediary, connecting users with Service Providers and does not offer transportation or delivery services itself.
• Electronic Communication: When interacting with this Website/Mobile Application or sending emails and other electronic communications via your desktop or mobile device, you engage in electronic correspondence with us. By sending such communications, you agree to receive responses from us in electronic form, and you have the option to retain copies of these communications for your personal records.

Our app is designed with simplicity and convenience in mind. Car owners can easily list their vehicles on our platform, setting their availability and rates to suit their schedule. When a user books a ride through our app, our dedicated drivers or car owners are ready to provide top-notch service, ensuring you reach your destination safely and comfortably.
6. MODIFICATIONS TO THE SERVICE
We reserve the right to exercise our discretion in making alterations, adjustments, enhancements, or removals, collectively referred to as "Changes," to these Terms at any time. You may be notified of these Changes through an email sent to the email address associated with your Account or by the publication of an updated version of the Terms, encompassing the Changes, on our Website and Mobile Application. Your continued use of the Site following the posting of these modifications indicates your acceptance and commitment to adhere to these Changes.
7. REGISTRATION
To access specific features and services on the GoRides website, you must complete a mandatory registration process to establish a user account. Upon registration, the system will generate credentials to facilitate your interaction with our services. Accuracy, currency, and completeness of information, such as your name, email address, and other pertinent details, are required during this process. It is your responsibility to maintain up-to-date and accurate information associated with your account.
Securing your account is of utmost importance, and you are accountable for maintaining the confidentiality of your account credentials, including your username and password. You are solely responsible for any activities conducted under your account. In the event of suspected unauthorized use or a security breach, timely notification to us is essential for appropriate action.
We reserve the right to suspend or terminate user accounts when necessary, especially in cases of a breach of these Terms, engagement in fraudulent activities, or non-compliance with our policies. The collection and processing of personal data for account creation and usage adhere to our Privacy Policy, and by creating an account, you consent to our data practices as outlined therein.

By creating an account on the GoRides website, you acknowledge that you have read, understood, and agreed to adhere to the terms and conditions specified in this Registration and Account Clause, as well as the entire Terms of Use governing your use of our website.
8. BOOKING PROCEDURE
• Booking Request: The process commences when users access the GoRides app and input their trip details, including the pickup location, destination, and any specific ride preferences. This may entail selecting the vehicle type, indicating the number of passengers, or requesting any special accommodations.
• Driver Matching: GoRides employs a sophisticated algorithm to swiftly identify available drivers in proximity to the user's location. This algorithm considers various factors such as the driver's proximity, vehicle type, and past ratings. Once a suitable match is found, users are promptly notified with details regarding the matched driver, including their profile, vehicle information, and estimated time of arrival (ETA).
• Confirmation and Ride Details: Upon successful matching, users receive a confirmation notification containing comprehensive ride details. This notification includes crucial information such as the driver's name, vehicle registration number, and the estimated time of arrival (ETA) at the pickup location. Users are afforded the opportunity to review and confirm the booking details before proceeding further.
• Ride Tracking: Throughout the journey, users have access to real-time tracking features within the GoRides app. This enables users to monitor the precise location of the driver and their ETA, thereby providing transparency and reassurance throughout the ride. By staying informed about the journey's progress, users can effectively plan and manage their time.
• Completion and Feedback: Upon arriving at the destination, users conclude the ride by confirming its completion within the GoRides app. Subsequently, users are prompted to provide feedback and ratings based on their overall experience. This feedback mechanism not only empowers users but also contributes to the maintenance of service quality and accountability within the GoRides community.
• Monitoring: Calls between you and the Service Provider may be monitored or recorded to improve training, service quality, and complaint handling.
• Service Provider Discretion: The Service Provider has the sole discretion to accept or reject your Service Request. Upon acceptance, you will receive a notification containing the Service Provider's details, including their name, contact number, and vehicle registration number.
9. HOW IT WORKS
• User Registration: To access the extensive features and services provided by GoRides, users must first complete the registration process. This involves providing fundamental details such as their name, email address, and contact information. Once registration is successfully completed, users are granted full access to the GoRides platform, enabling them to seamlessly book rides and utilize various functionalities.
• Booking a Ride: Users initiate the ride booking process by inputting their trip details into the GoRides app. This includes specifying the pickup location, destination, and any additional ride preferences they may have. Upon submission, the app swiftly matches the user with an available driver who best fits their requirements. Users receive detailed information about the matched driver, including their estimated time of arrival (ETA) and vehicle details, facilitating an informed decision before confirming the booking.
• Riding Experience: Throughout the journey, users can actively monitor the real-time location of their assigned driver and track their estimated time of arrival (ETA) using the GoRides app. This feature empowers users with transparency and control over their travel experience, ensuring peace of mind and effective time management. Upon reaching the destination, users conclude the ride within the app and are prompted to provide feedback and ratings based on their overall experience, contributing to the enhancement of service quality within the GoRides community.
• Payment Settlement: GoRides offers users a secure and convenient payment settlement process directly within the app. Users can choose from various payment methods to settle their ride fares, including credit/debit cards, digital wallets, or other electronic payment options. GoRides facilitates the seamless transfer of the fare amount from the user's selected payment method to the driver's account, ensuring a hassle-free and transparent transaction process.
• Management and Support: Users can effortlessly manage their ride bookings, payments, and subscription preferences directly through the GoRides app or website. Our dedicated customer support team is readily available to address any inquiries, resolve issues, or provide assistance as needed, ensuring a seamless and enjoyable experience for all users of the GoRides platform.
10. USER CONTENT
A. Content Responsibility.
The Website/Mobile Application provides you with the opportunity to contribute content, feedback, and more. It is essential to recognize that you bear full responsibility for the content you submit. By submitting content, you affirm that you have the necessary permissions for its usage.
When engaging in content submission on the Website/Mobile Application, please refrain from submitting content that:
• Contains language, text, photographs, or visuals that are disrespectful, profane, abusive, racially or religiously offensive, or filled with inflammatory attacks.
• Is defamatory, fraudulent, inaccurate, misleading, unfair, contains exaggerations, unsupported claims, or derogatory remarks, or is highly inflammatory.
• Violates the privacy rights of third parties, is excessively harmful or offensive to individuals or communities.
• Discriminates based on race, religion, national origin, age, marital status, gender, sexual orientation, disability, or contravenes any applicable laws.
• Violates or encourages violations of local, state, federal, or international laws, regulations, rules, or ordinances.
• Repeatedly contacts another user, engages in offensive comments about others, or posts the same message multiple times using different email addresses or subjects.
Any content submitted that meets these criteria will be rejected by us. In cases of repeated violations, we reserve the right to terminate a user's access to the Website and Mobile Application without prior notice.

Prior to confirming the booking, users are provided with an estimated fare, allowing them to make informed decisions regarding their ride selection. In instances where users choose to make payment through the app, GoRides undertakes the responsibility of facilitating the payment settlement process. This involves deducting the fare amount from the user's preferred payment method and promptly transferring it to the driver's account, post deduction of any applicable service fees. • Subscription Model: Car owners and drivers seeking to list their vehicles on the GoRides platform are mandated to subscribe to our services. The subscription model encompasses a variety of subscription plans, spanning monthly or annual durations, each tailored to meet the unique needs and preferences of subscribers. These subscription tiers offer an array of features and benefits, ranging from enhanced visibility and marketing tools to access to exclusive promotions and incentives. By subscribing to our services, car owners and drivers gain access to a host of resources and opportunities designed to maximize their earning potential and optimize their presence on the GoRides platform.
• Subscription Management: GoRides affords users with the ability to seamlessly manage their subscription preferences directly through the app or website. This encompasses a spectrum of options, including subscription renewal, upgrades, or cancellations, allowing users to exert control over their subscription status in alignment with their evolving needs and preferences. Subscription fees are subject to the terms and conditions outlined during the subscription sign-up process, ensuring transparency and clarity in the subscription management process. By empowering users with robust subscription management tools, GoRides enhances user autonomy and cultivates a user-centric platform experience.
12. GENERAL CONDITIONS
• We cannot guarantee the accuracy, completeness, validity, or timeliness of the information provided by us.
• In the event of significant alterations to these terms and conditions, we may notify you through conspicuous placement of the changes or via email communication.
• The Website/Mobile Application is provided to you under a limited, non-exclusive, non-transferable, and non-sublicensable license. Its usage is strictly tied to the Service, intended for personal, non-commercial purposes, and is subject to the terms and conditions outlined in this Agreement.
13. LIMITED GUARANTEE
Through this Website/Mobile Application:
• You are provided with the opportunity to access the services offered on our Website/Mobile Application.
• The Company will not be responsible if:
• You download the wrong version of the app or access the incorrect web portal.
• A Service Provider fails to arrive at the pick-up location after accepting the Service Request.
• The Company acts solely as a facilitator through the platform and is not responsible for the actions or inactions of the Service Provider.
• We do not guarantee or warrant that the service descriptions are accurate, exhaustive, reliable, up-to-date, or free from errors. If a Service provided by the Website/Mobile Application does not align with its description, your sole course of action is to inform us of the issue for appropriate measures to be initiated.
14. PAYMENT SETTLEMENT
GoRides operates as a facilitator in the payment settlement process between customers and car owners/drivers for ride services booked through the platform. Our platform provides a secure and streamlined mechanism for users to conduct transactions, enhancing convenience and reliability. However, it is imperative to clarify that GoRides assumes no responsibility for payments made directly between the involved parties outside of the platform's designated payment system.
In cases where transactions occur outside of the GoRides platform, such as cash payments between the customer and the car owner/driver, GoRides explicitly disclaims any liability for disputes, discrepancies, or issues that may arise. It is the shared responsibility of both parties to adhere to the agreed-upon terms and conditions and to handle any payment-related matters independently.
While GoRides strives to maintain transparency and facilitate fair dealings within its community, it is important for users to exercise caution and diligence when engaging in payment transactions. Any concerns or discrepancies regarding payments should be promptly communicated and addressed by the parties involved, with GoRides available to provide assistance and support as needed.
15. SAFETY STANDARDS
Ensuring the safety and security of all users is a fundamental priority at GoRides. We maintain rigorous safety standards and protocols to mitigate risks and uphold the well-being of our community members. While every effort is made to vet and verify all registered car owners/drivers, it is essential to recognize that GoRides cannot guarantee the behavior or actions of individuals utilizing our platform.
Users are strongly encouraged to exercise vigilance and caution, particularly when interacting with unfamiliar drivers or traveling to unfamiliar destinations. Any instances of suspicious behavior, misconduct, or safety concerns should be promptly reported to GoRides for thorough investigation and resolution.

16. USER RESPONSIBILITIES

• Engaging in impersonation of individuals or entities for fraudulent or unlawful objectives is strictly forbidden.
• Unauthorized use of devices, scrapers, or automation to access the Website or Mobile Application is not allowed without prior permission.
• In the event of encountering any inappropriate or illegal content, you should promptly notify us.

The GoRides app is equipped with an Emergency SOS Button to ensure the safety and security of our users during their journeys. This feature is designed to provide immediate assistance in emergency situations.
• Direct Connection to Police Help: When the SOS button is pressed, it connects the user directly to the police helpline, ensuring prompt response and support from law enforcement authorities.
• GoRides Helpline Support: In addition to the police helpline, Users can directly contact the GoRides support team for assistance by dialing the helpline number, which is prominently mentioned in the app. Our dedicated team is available to address emergencies and provide necessary guidance to ensure user safety.
• Quick Access: The SOS button is easily accessible in the app, allowing users to request help with just one tap, ensuring a fast and effective response during emergencies.

To ensure your safety and a secure travel experience, it is essential to verify the driver's name, photo, vehicle registration number, and vehicle model displayed in the GoRides app before starting the ride or seating in the vehicle. Carefully match these details with the driver and vehicle present at your pickup location.
This simple step ensures that you are traveling with the correct and authorized driver assigned to your booking, preventing any unauthorized rides or potential misuse. In case the details do not match, do not board the vehicle. Instead, cancel the ride immediately and report the issue through the GoRides helpline or the Emergency SOS Button available in the app.
By verifying these details, you not only prioritize your safety but also help maintain a secure and trustworthy environment for all GoRides users. Your safety is our utmost priority, and we encourage all users to take this important step before starting their journey.
46. INDEMNIFICATION
You agree to defend, indemnify, and hold us, as well as our officers, directors, employees, successors, licensees, and assigns, harmless from and against any claims, actions, or demands, including but not limited to reasonable legal and accounting fees, that arise from your breach of this Agreement or your improper use of the Content or the Website/Mobile Application. We will provide you with notice of any such claim, lawsuit, or proceeding and will assist you, at your expense, in the defense of such claims, lawsuits, or proceedings. We reserve the right, at your expense, to assume the exclusive defense and control of any matter that is subject to indemnification under this section. In such a scenario, you agree to cooperate with any reasonable requests to aid in our defense of the matter.
47. MISCELLANEOUS
SEVERABILITY

TERMINATION

• Auto Services:
Passengers can cancel an auto booking up to 30 minutes before the scheduled pickup time without incurring any cancellation fees.

• No-Show:
